AN ORDNANCE TO CONTROL DOGS AND CATS AND OTHER PETS AND ANIMALS
To AMEND ORDNANCE 96-12, ORDINANCE 98-5, AND ORDINANCE 98-5B
WHEREAS, Ordinance 96-12 was passed to control dogs, cats, and other pets and animals and,
WHEREAS, Ordinance 98-5 was passed to amend Article VIl, Section 3 of Ordinance 96-12 and,
WHEREAS, Ordinance 98-5B was passed to amend Article VIl, Section 1 and 3, and Article XI, Section 3
WHEREAS, Ordinance 98-5, Section 3 and Ordinance 98-5B, Article Vll, Section 3 and Article XI, Section 3 are need of amendment;
WHEREAS, Ordinance 96-12, Article V, Section ; Article Vll, Section 5; and Article Xl, Section 3 are in need of amendment;
NOW, THEREFORE, BE IT ORDAINED by the City Council of the City of Dover, Arkansas that Ordinance 96-12, Ordinance 98-5, and Ordinance 98-5B are hereby amended to read as follows:
- ARTICLE Vll, SECTION 3: IMPOUNDING FEES AND COSTS
- At which time the owner reclaims the pet a reasonable indemnification shall be paid which reflects the cost to the City of upkeep of said pet during impoundment in the amount of five dollars ($5.00) per day.
- At which time the owner reclaims the pet an impounding fee of twenty-five dollars ($25.00) for the first impounding, thirty-five dollars ($35.00) for the second impounding, and fifty dollars ($50.00) for the third impounding in one year shall be paid. The upkeep cost and impounding fees shall be paid to the City Clerk and all monies collected shall be paid into he general fund of the City of Dover.
- ARTICLE V, SECTION 1 : PROHIBITION
(D) No pet shall be permitted to be unattended in any parks or any swimming areas open to the public in the City. No pet, attended or unattended, shall be permitted in Lovelady Field. This paragraph shall not apply to any person who is visually or physically handicapped.
- ARTICLE Vll, SECTION 5: DISPOSAL
- If such pet has been so impounded for a period of five (5) working days without having been reclaimed by its owner or anyone on behalf of said owner, said pet shall be destroyed.

- Prior to destroying the animal, the City shall give the dog’s owner at least five (5) days notice of the date of the proposed destruction of the dog pursuant to A.C.A. 14-54-1102. The notice shall be by certified letter, return receipt requested. The dog owners may claim their dogs at the City impound by reimbursing the city for the cost of the notice plus other costs of impoundment as set forth in Article 7, Section 3. This subsection shall apply only in instances where the dog carries its owner’s address.
- ARTICLE Xl, SECTION 3: FNES
- Any violation cited in this Ordinance, and such penalty not otherwise listed, shall carry a penalty of not more than fifty dollars ($50.00) for each violation cited.
- Any and all other ordinances or provisions of other ordinances not directly in conflict with the provisions of this ordinance shall remain in full force and effect.
- EMERGENCY CLAUSE. This ordinance is necessary to bring prior ordinances into conformity with currently law and to protect the peace health, safety, and welfare of the citizens of Dover, Arkansas and requires immediate effectiveness to safeguard the interests of the City of Dover. Therefore, an emergency is hereby declared to exist and this ordinance, being immediately necessary for the preservation and protection of the public peace, health, safety, and welfare, shall take effect and be in full force immediately upon its passage.
