AN ORDINANCE PROHIBITING THE UNSAFE DISCHARGE OF FIREARMS IN THE CITY OF DOVER, ARKANSAS; PROVIDING EXCEPTIONS THEREFORE & PENALTIES FOR VIOLATIONS; REVOKING PRIOR CONFLICTING OR INCONSISTENT ORDINANCES; AND FOR OTHER PURPOSES
WHEREAS, pursuant to A.C.A § 14-54-1411(b)(l)(B) the City Council of Dover, Arkansas may enact an ordinance regulating the unsafe discharge of a firearm in the city limits.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF DOVER, ARKANSAS:
SECTION 1: The discharging or firing of any firearm which shoots a projectile or pellets propelled by the explosion of gun powder within the city is prohibited with the following exceptions:
(1) When discharged or fired by a duly constituted law enforcement officer and when necessary in the performance of his duties or training.
(2) The discharge of any firearm on any public or private rifle or pistol range, or shooting gallery approved for use in writing by the City and the chief of police.
SECTION 2: Any person found guilty of violating the provisions of this ordinance shall be found guilty of an unclassified misdemeanor and shall be fined not less than $100.00 and no more than $500.00 for each violation.
SECTION 3: No provision of this Ordinance shall be construed or interpreted to regulate in any other manner, the ownership, transfer, transportation, carrying, or possession of firearms, ammunition for firearms, or components of firearms, except as otherwise provided in state or federal law as set forth in A.C.A § 14-54-1411.
SECTION 4: The provisions of this Ordinance are declared to be severable. In the event any title, section, paragraph, item, sentence, clause, or word of this Ordinance is declared or adjudged to be invalid or unconstitutional by a court of competent jurisdiction, such decision, declaration or adjudication shall not affect the remaining sections, sentences, clauses, phrases, or portions of this Ordinance, but they shall remain in full force and effect; it being the legislative intent that this Ordinance shall remain in effect notwithstanding the validity of any part.
SECTION 5: All ordinances or resolutions or portions thereof, of the City in conflict herewith are hereby repealed to the extent of such conflict.
